    No, I am saying that the courts should decide guilt or suspensions. Magic in no way should have ever missed a game if he was healthy enough to play.
     
  2. OK, then I concede I should have been more clear. I meant "assuming that, for the sake of argument, the sex was consensual."

    I do think that plenty of people probably read it that way, however.

    Yeah, Karl Malone's motivation was morality.

    Come on. His motivation was twofold:

    - "I'm really ignorant about HIV and its transmission."
    - "Wait . . .when Magic's around, we can't beat those guys."

    Morality had less than nothing to do with Malone's stupidity.

    I invite them to come out of the woodwork. And I'll be happy to concede when they do.
     
  5. Yes. "Rape shield law," I believe, is just the term people use as shorthand.

    But the answer to any question like that is that it depends on the state. But I would think that they pretty much universally apply to any sexual offense where there's a victim.

    The forensic evidence that said there was no DNA involved and no real evidence of a rape or even strong proof that there was sexual intercourse -- which is a big reason there is no charges being filed.

    It really is her word against his - and by the way one other thing - the orginal statement contained enough inconsistenicies and/or holes that she wasn't regarded as a credible witness.

    I think Big Ben is a scum. I think he is the kind of arrogant prick that can't imagine a woman saying no to him.

    I also know that this is still America --- despite the best efforts of some people to try and destroy it -- and you can't convict someone of a crime just because you are repulsed by his behaviour.

    Is a suspension warranted, then? The National Football League is a private organization that has the right to suspend its employees for conduct detrimental to its image.

    Magic getting HIV hurt the image of the NBA. I think he was married as well, right?

    Employeers suspending good, productive employees just because they do not like something about the person, IMHO, is wrong.
