    It is both, but I think it is fair to question if some involved in the discussion even understand what it was about.

    On topic, look at the video. She shoved Mixon and then he lunged at her, faking as if he would hit her. At that point she reached out and placed her left hand against his arm or chest (it is hard to tell), but did not grab him with it as franticscribe claimed. Then she slapped him with her right hand. Even by the strict but subjective definition of battery presented by the SJ.com legal duo on this thread, it is ridiculous to claim that she committed battery three times in that video. The touch with the left hand was in response to Mixon's lunge. Pardon me for pointing out the inaccuracy before shit went sideways.

    Somewhere in there, franticscribe claimed he has won a battery case on a touch like that. If so, I bow to his legal genius and his ability to exert mind control over 12 folks on a jury. If that truly is considered battery in all cases, then he's going to be a very busy man.

    Of course, if we could have heard what was said, it would have added to our understanding of the event, but we didn't.

    Now if some folks want to claim that she deserved what she got for shoving Mixon and then slapping him in the face, that's fine. I disagree, but I get it. If y'all want to claim that she should lose a civil suit because what she did could legally be considered two acts of battery, that's fine, too. But it is a real stretch to call it three and it is also a stretch to call that touch with her left hand a grab. Also I say could be considered battery not because the shove and the slap don't fit the definition, but because she wasn't charged with battery in this case.

    I would also wish you all a nice day, but as George Carlin said, there's a problem with have a nice day. It puts all the pressure on you.

    If she touched him with her left hand because she was afraid when he lunged at her, that's a defense, something which she has to prove to not be convicted of battery.

    And the argument that it could be considered that she didn't commit battery because she wasn't charged is silly. Not all crimes committed are reported and not all crimes reported are prosecuted. You have to know that.
