    I didn't engage your earlier posts because I didn't see anything worth responding to. But I'll answer your last question. Yes, that is a battery.

    Florida's definition of battery, courtesy of Johnson v. United States, 130 S.Ct. 1265 (2010), is that "a battery occurs when a person either '1.(a)ctually touches or strikes another person against the will of the other,' or '2.(i)ntentionally causes harm to another.'" 1269. Emphasis added.

    I've won battery cases on slight, unwanted touching, OOP. You really are out of your depth here.

    I don't want to argue with you, PC, because you're one of the more well-reasoned posters here. But again, that's why there's just no having a debate on this. Either it's going to devolve into name-calling or everyone is going to agree. That's SJ.com.

    Deleting just makes it worse. Doesn't matter if he's right or wrong, don't delete it.
    He will (and should) take more criticism for deleting it than for what he tweeted.

    If that is true, I truly am concerned for your cognitive abilities.

    Seriously, go back and read that explanation of connotation vs. denotation. It might help.

    Also, I'll put this in the form of a more direct question this time. franticscribe claimed that she battered him three times. In your opinion, does what she did with her left hand before slapping him with the right constitute battery?

    That was my initial point, that scribe was inaccurate in claiming she battered him three times. Even by what seems like a ridiculous definition to me, she only did it twice. After she shoved him, he lunged toward her as if he was going to hit her. At that point, she put her left hand against his chest or shoulder, but she did not hit or grab him with it.
