The Senate adopts the filibuster rules by majority vote (50+1) at the opening of each session.

If the Dems take 50 seats in the November election, on Jan. 2 at the opening of the new session, they could eliminate the filibuster completely: allow bills to be brought to the floor at any time on simple majority vote. (That's how the House works.)

Historically this has not been done because of fears, "if the other side takes over, they will ram through everything they want."

So what's to lose? The GOP has already proven its utter irresponsibility with the filibuster. The filibuster was never intended to allow a minority party to obstruct all legislation forever.

You don't know what you're talking about. That's EXACTLY what it was -- an absolute check on the majority. It was only in the mid-1800s that it was done away with in the House. They only began to trim it in the Senate in the early 1900s.

But despite the overwhelming evidence, he WILL deny it. Because that's how he rolls.

I'm still waiting for the part where "filibuster" appears in the Constitution.
