I wonder if a bit of lawyering might get her out of this. Obviously she should no longer work in the schools, but does she meet the definition of employee under whatever Nebraska's anti-Poin laws might say? It's almost more of a contractor setup. Age of consent there is 16.

I am pretty sure subs are employees of the school district.
 
In my area, it depends on the district. Large schools seem to have contracted with temp agencies, Kelly Services being the most prominent. Rural districts still rely heavily on retirees.

I'm seeing contracting agencies pop up as well. But I think they are covered by the same laws as teachers. I think there's background checks for subs (I know I had to do one).
